1. Scope
These terms and conditions apply to all contracts for the rental of apartments, premises, or parts of the Finca El Drago (hereinafter "Lessor") by guests (hereinafter "Lessee") for accommodation, retreats, private events, or other stays.
2. Conclusion of Contract
A binding rental contract comes into effect upon written booking confirmation by the Lessor. The booking becomes binding once the deposit in accordance with section 4 has been received.
3. Services and Prices
The agreed services are outlined in the booking confirmation. Any amendments or additions must be made in writing. The valid price list at the time of booking is an integral part of the contract.
4. Payment Terms
To confirm the booking, a deposit of 50 % of the total amount is required. The remaining balance is due on the day of arrival. Payments can be made by credit card or bank transfer unless otherwise agreed.
5. Booking Conditions
The following conditions apply to all bookings:
Deposit to confirm reservation
A 25% deposit of the total amount is due at the time of booking. This deposit secures the reservation.
Payment 60 days before arrival.
A further 25% of the total amount must be paid no later than 60 days prior to arrival. Until this date, free cancellation is possible. In case of cancellation up to 60 days before arrival, the deposit will be fully refunded.
Final payment
The remaining 50% of the total amount is due immediately before arrival.
6. Arrival and Departure
Check-in is generally possible between 2:00 p.m. and 6:00 p.m. Check-out must be completed by 11:00 a.m. on the day of departure. Earlier or later times must be agreed individually.
7. Use of the Accommodation and Property
The rental property may only be used by the number of persons specified in the booking. Subletting or transferring the rental to third parties is not permitted. The lessee agrees to use the premises responsibly and follow the house rules.
Rental of the Finca or individual areas (e.g., garden, yoga shala, event spaces) for events, retreats, or private celebrations is possible by separate agreement. The use of apartments or shared areas for private parties, especially with music or larger gatherings, is only permitted with the prior consent of the Lessor.
8. Liability
The Lessor is not liable for the loss or damage of personal belongings. The Lessee is liable for any damages caused by them. The Lessor is not liable for force majeure such as power outages, natural events, or pandemic-related restrictions.
Use of the playground is at your own risk. The Lessor assumes no liability for accidents involving children; parents are responsible for their children.
The pool may only be used by individuals who can swim. Supervision and liability also rest with the parents or guardians.
Use of the premises for retreats hosted by external organizers is at the organizer's own responsibility. The Lessor accepts no liability for the content, conduct, or consequences of these activities.
9. Pets
Pets are only permitted with prior agreement and the explicit consent of the Lessor. The Lessee is fully liable for any damages caused by pets.
10. Quiet Hours
Out of consideration for other guests and neighbors, quiet hours must be observed from 10:00 p.m. to 9:00 a.m. For events or gatherings with extended hours, a special agreement is required.
11. Cleaning and Deposit
Final cleaning is included in the price, provided the accommodation is left broom-clean and in proper condition. For excessive dirt or damage, the Lessor reserves the right to charge a cleaning fee or retain compensation. A deposit may be agreed upon for special events.
12. Smoking Policy
Smoking is not permitted in any indoor areas of the Finca. Smoking is allowed in designated outdoor areas, provided it does not disturb other guests.
13. Data Protection
Personal data collected during the booking process will be used solely for contractual purposes and will not be passed on to third parties unless required by law.
14. Applicable Law and Jurisdiction
The applicable law is that of the Kingdom of Spain. The place of jurisdiction, to the extent permitted by law, is Santa Cruz de Tenerife.
15. Severability Clause
Should individual provisions of these terms and conditions become invalid, the validity of the remaining provisions shall remain unaffected.
